Employment Law Compliance Plan Essay

I have researched several employment laws for Mr. Stonefield’s Landslide Limousine Company and there are four laws that I will outline for Mr. Stonefield to consider complying with in his new business venture. I will discuss in this memo the Civil Rights Act of 1964 regarding employment discrimination, The Americans with Disabilities Act of 1990 regarding people with disabilities, Equal Pay Act of 1963 regarding wage discrimination between men and women, and lastly the Texas Minimum Wage Act regarding the least amount of an hourly wage payable in the state of Texas. I will give a brief summary of each of the four Acts and consequences for noncompliance. Civil Rights Act of 1964 The Civil Rights Act of 1964 is regulated and enforced by the Equal Employment Opportunity Commission (EEOC). As a new business, if you receive any federally funded monies such as grants, assistance, or subsidies The  Civil Rights Act of 1964 applies to you. The EEOC â€Å"enforces laws that prohibit discrimination based on race, color, religion, sex, national origin, disability, or age in hiring, promoting, firing, setting wages, testing, training, apprenticeship, and all other terms and conditions of employment† (The United States National Archives and Records Administration, n.d., para. 3). The Civil Rights Act of 1964 makes it unlawful for employers to â€Å"fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions or privileges or employment, because of such individual’s race, color, religion, sex, or national origin† (The United States National Archives an d Records Administration, n.d., para. 2). The Civil Rights Act has been expanded to include subsequent legislation. According to the United States Government Manual of 1998-99, â€Å"the EEOC enforces laws that prohibit discrimination based on race, color, religion, sex, national origin, disability, or age in hiring, promoting, firing, setting wages, testing, training, apprenticeship, and all other terms and conditions of employment† (The United States National Archives and Records Administration, n.d., para. 3). Protected classes now include race, color, creed, sex, and age. As you can see, the spectrum of inclusion has been increased to protect the employee. Consequences for noncompliance Once a business has been found to be in violation of The Civil Rights Act of 1964 the penalties are substantial. Consequences for violating The Civil Rights Act can result in federal funding can be withdrawn for a specific time or terminated and monetary fines. Marion Shaub, a former Federal Express (FedEx) truck driver, sued her employer after she reported anti-female comments, hostility, and retaliation when she reported the incidents. The EEOC reports â€Å"The jury found Federal Express liable for a sex-based hostile work environment and retaliation and awarded Ms. Shaub $391,400 in back pay and front pay, $350,000 in compensatory damages for emotional pain and distress, and $2.5 million dollars in punitive damages† (United States Equal Employment Opportunity Commission [EEOC], 2004, para. 2). Americans with Disabilities Act of 1990 The Americans with Disabilities Act (ADA) of 1990 â€Å"prohibits discrimination  against people with disabilities in employment, transportation, public accommodation, communications, and governmental activities† (United States Department of Labor [DOL], n.d., para. 1). The ADA requires employers to provide reasonable accommodations to employees that have disabilities or may have accessibility requirements to be able to use public accommodations. Under the ADA, disabilities include physical and mental conditions with varying degrees of severity. A few examples are deafness, blindness, missing limbs, epilepsy, cancer, and mental retardation. The Department of Labor provides assistance with the ADA but four federal agencies are responsible for enforcing the ADA. Those four agencies are the EEOC, The Department of Transportation (DOT), The Federal Communications Commission (FCC), and The Department of Justice (DOJ). Consequences for noncompliance As with The Civil Rights Act of 1964, withdrawal and termination of federal funds is possible of companies that violate The ADA. One example is Bates v. United Parcel Service (UPS). This particular case brought against UPS brought to issue â€Å"the hearing standard that is part of the DOT physical† (Case Law Find Law, 2015, para. 9). The plaintiffs contended that even with a hearing disability and not passing the DOT hearing test they were still able to operate vehicles that were below the required gross vehicle weight rating (GVWR) of 10, 001 pounds. UPS agreed to pay $5.8 million and to create a program that was implemented nationally throughout UPS. Equal Pay Act of 1963 The Equal Pay Act of 1963 states, â€Å"Employers may not pay unequal wages to men and women who perform jobs that require substantially equal skill, effort and responsibility, and that are performed under similar working conditions within the same establishment† (Society for Human Resource Management [SHRM], 2015, para. 2). What this means is that men and women are to be given equal pay for doing the same types of work however, the work does not have to be exactly the same but equal, within the same employer. Skill, effort, responsibility, working conditions, and establishment are factors that employers must keep in mind when paying wages to men and women doing similar jobs in similar work environments. Wage differences can exists when merit, seniority, or any other factor exists as long as it is not a person’s  gender. When there are wage differences the burden of proof falls on the employer to prove why the difference exists. Consequences of noncompliance Corning Glass Works violated the Equal Pay Act by paying male employees who work a night inspection shift a higher wage than females doing the same inspections during the day inspection shift. Corning Glass also tried to correct this by opening up the night inspection shift to women and implemented a unionized shift differential to equalize pay however, employee employed prior to the changes continued to receive higher wages continuing to create a difference in pay. The Secretary of Labor brought the charges against Corning to collect back wages for the women who had been violated. Texas Minimum Wage Act The Texas Minimum Wage Act (TMWA) provides information about rights and duties for both employees and employers. The TMWA establishes the minimum wage at $7.25, requires employers to provide a written statement of an employee’s earnings, outlines provisions for agricultural workers, provides exemptions for different types of employers, and civil penalties for violations. All employers must display the current Texas minimum wage poster in an obstruction free area so that all employees can see what the minimum wage is and their rights as workers in Texas. Recommendations for Compliance In closing, compliance with Federal, State, County, and City laws is strongly recommended. Landslide Limousine Company can be shut down and fined heavily for violations brought by employees. The burden of proof is on you as the employer and understanding all of the laws applicable to your business is necessary. Investigations by any of the federal departments who are responsible for investigating and enforcing the employment laws can tie up your resources for months, possibly years. However, not all judgments go against the employer. My recommendation is to understand the laws, document well, keep pristine records, and do your best to remind within the guidelines for employers. Efforts to solve inequality in South Asia have had no Impact. † How far do you agree? Explain your answer with reference to examples from both gender and caste inequality. In south Asia, there are critical Inequalities practicing, especially the gender and caste Inequalities. Realizing the harm that these Inequalities will bring, governments as well as non-government organizations are putting great efforts to improve this situation. At present, 22. 5% of places in government-funded academic institutions are set aside for Dalais and listed tribes who make up roughly 25% of the population. In the poem ‘Genesis', children are expelled from innocence into the harsh realities of the world by partaking of the tree of knowledge – education at school. He has achieved this critical commentary by lightly incorporating the technique of gentle satire into the poem to attack the human folly. This satire implies that society has not learnt from Adam and Eve's mistakes and condones the sinful behaviour in the name of â€Å"education†. His idea has been put forward by the interpretations that God created Adam and Eve, of whom lost their innocence from the tree of knowledge, but society created the cause of the loss of innocence through education. In the lines â€Å"Ah, what ink-stained webs we weave†(1.23), Dawe implies that the adults of society have created a trap (that cannot be untangled) for their children, in their desire for their children to know more, almost pushing them into losing their purity of heart. This satire has made possible by the technique of irony because the Garden of Eden is supposed to harmonise paradise, but school is far from paradise; yet is respected and designated as a ‘good' place by society. This implication is made by the words â€Å"Like old ‘lags' to whom all's one!† (1.7). ‘Lag' was the name given to a convict in the early days of Australian's history and refers to the children who are â€Å"imprisoned† in their classrooms. The fact that all cells look the same illustrates their lack of interest in their classrooms. It all symbolises the loss of freedom. The children's loss of freedom innocence is shown throughout the poem and is illustrated by examples of them choosing bad over good. â€Å"Dumping wholesome snacks Mum makes, In the school incinerator† (1.22) and eating â€Å"tooth-rotting cakes† (1.19) and drinking â€Å"Mind-destroying Fizzi-cola† (1.20). With the help of his mindful selection of words such as, ‘mincing' and ‘cocky' he has built up the imagery that incorporates the sense of flirtatiousness and rebelliousness in the students. Other effects of imagery include the use of metaphor where Dawe compares the delay of sound from a jet-plane to the delay of understanding from the school children when faced by the information in their new text-books. â€Å"Like jet ‘planes so far above them, Waiting for the sonic boom† (1.16-17). The use of simile is also closely connected with the metaphor, where Dawe compares the difficulty of schoolwork to the difficulty of reaching a jet-plane. â€Å"Text-book whose right answers loom, Like jet ‘planes so far above them†(1.15-16). By using both techniques, Dawe enables the reader to visualise more clearly the poet's impressions. The words used by Dawe are vivid and image is substantial, yet simplistic. This allows readers of all levels to appreciate and understand his writing even those who do not normally care for poetry. He has accomplished this in ‘Genesis' by using compound words throughout the whole poem, which allow him to describe ideas promptly and concisely, producing a clear image of his intentions: â€Å"†¦Ã¢â‚¬ ¦Ã¢â‚¬ ¦tooth-rotting cakes, Mind-destroying fizzi-cola† Along with these compound adjectives his rhyming pattern and regular rhythm futher enhances ease of reading and permits the poem to become almost harmonious. Dawe's negative connotations of school, aroused emotions of sadness. This is because I believe the poem speaks of truth of that innocence is lost in school, a place that provides one of the most important aspects to life, education. Dawe has created this poem to comment on the tragedy of the human race, that is to say, what children have become since Adam and Eve. However, I find that his negative attitudes are not necessarily accurate. Despite my disagreeing view with Dawes beliefs, he has nevertheless been successful in conveying his intentions – to satirise the human obsession with education and the emphasis placed on school learning. He has achieved by incorporating many techniques into his work.

Materials: – one 1 liter coke bottle with cap – one plant (bought from pet store) – 3 Super Worms – 2 cups of soil – water – sunlight – sawdust (food) – scissors – duct tape – notebook to record data Procedure: All the materials were collected. Then, a scissor was used to cut a half moon shaped opening in the top of the bottle, approximately 1 inch below the cap. Next, half the soil was pored into the opening. Then the plant was placed into the soil, while poring the other half over the bottom of the plant to ensure proper growth. After, 3 super worms were put into the Ecosphere with some sawdust. The EcoSphere was taped shut and placed on a windowsill with good sunlight exposure. Data was recorded at that moment and everyday, for 20 days, following. Analysis: My hypothesis was very incorrect. Two superworms ended up surviving, while the plant was wilting and struggling. One superworm died due to it getting stuck. Unable to get out, I assume it died of starvation or hypothermia because the worms spent all of their time under the soil. I believe the plant wilted because it did not have enough space and oxygen inside of the EcoSphere. During the experiment, I believe the EcoSphere was knocked off the window. This could have hindered the plant’s growth also. The plant could have been up-rooted during the fall causing its deterioration. Conclusion: In conclusion, the EcoSphere project is important to our curriculum because it evaluates the bio-geochemical cycles, as well as tests limiting factors. We, as readers learn a lot about her character from the way she speaks, by what is said about her and by the stage directions. We also gain a good insight into her relationships with the people around her. Margarets relationship with Brick comes across as quite bizarre. His lack of interest in what she has to say gives the impression that he doesnt care and also shows a slight lack of respect. For example, when Brick replies to Maggies first line in the play, he says Whad you say, Maggie? The stage directions prior to his response read A tone of politely feigned interest, masking indifference or worse. Other stage directions describing his attitude to Maggies statements share the same negativity; such as Without interest., Wryly, Absent mindedly, Dreamily, followed by sarcastic comments. We also get the impression that Brick doesnt find his wife as attractive as other men do. On page twenty-one, Maggie says Way he always drops his eyes down my body when Im talkin to him, drops his eyes to my boobs an licks his old chops! The fact that shes telling her husband how other men show interest in her comes across as a subtle hint to her husband that perhaps he should appreciate her more. On page twenty-five, Maggie says I wish you would lose your looks This is a particular strange request to make of ones partner. It makes readers assume she doesnt want to be attracted to Brick any longer. This assumption is soon backed up with fur ther lines on page twenty-eight when the couple talk of the conditions Maggie has to follow in order for Brick to continue living with her. They also refer to their bedroom as a cage, giving the sense of entrapment. Margarets relationship with Mae seems strained and false. Maggies continuous insulting of Maes children gives the impression that they dont get along particularly well. The topic of children in Maggie and Bricks relationship also seems awkward. Mae seems to take a patronising tone with Margaret on page twenty-nine when she says Maggie, honey, if you had children of your own youd know how funny that is It seems that Mae is well aware of Maggies envy towards her for having children and likes to bring it up from time to time. Margaret often refers to Big Daddy when shes attempting to make Brick jealous. When she was talking of the man who was looking her up and down, she was talking of Big Daddy, Bricks father. She uses him as an example of a man who gives her attention to try and get Brick to do the same. She also talks of Big Daddy not getting along with Gooper, Bricks brother or Mae. On page twenty, she says Big Daddy dotes on you honey. And he cant stand Brother Man and Brother Mans wife Big Daddy is also supposed to be dying of cancer, therefore theres a lot of talk of who will be getting the large share of his will. Margaret is obviously very aware of her sexuality. On the first page of the play, a stage direction says She steps out of her dress, stands in a slip of ivory satin lace. She also cares a lot about her appearance and what Brick thinks of her. I feel this because of her asking Brick what he thinks of her when he looks at her and because of stage directions such as She adjusts the angle of a magnifying mirror to straighten an eyelash Her relationship with her husband seems one sided and cruel. It seems as thought she wants children and a happy marriage like her sister in law however its made obvious that Brick doesnt share the same passion. We know from the continuous talk of Big Daddys will that she has dreams of being rich. So far, Williams has made Maggie seem like a desperate, hurt character that covers her pain up with her loud personality.
